Injuries suffered in a Texas truck accident can be absolutely devastating. When a large truck strikes a smaller vehicle, it is often the occupants of the smaller vehicle who suffer serious injuries. These accidents often result in fatalities as well. If you have been seriously injured in a truck accident in Dallas, it is important to understand how liability is determined and who can be held liable.

Depending on the circumstances of the case, there are several parties that can be held liable. First, if the accident was caused by driver error or negligence, he or she can be held liable for the incident. Was the truck driver under the influence, distracted, speeding, fatigued, or inattentive? In addition, since the driver was on the job at the time, his or her employer can be held liable as well. This could be the truck owner or the owner of the distribution company that operates the truck. The owner of the truck is responsible for proper vehicle maintenance. In fact, trucking companies are required to keep vehicle maintenance logs for all their trucks.

In addition to the driver and truck owner, other parties may also be held liable. For example, if a defective truck part caused the accident, then the manufacturer of the defective product can be held responsible. Also, if a dangerous roadway condition caused the accident, then the governmental agency responsible for maintaining the roadway or public property can also be held liable.

If you or a loved one has been injured in a truck accident, please contact an experienced Lewisville truck accident lawyer who will review the circumstances of your case, help preserve critical evidence, such as driver and maintenance logs, and protect your rights.

A truck driver from Lewisville is facing charges after officials say he caused an accident that killed a 53-year-old man and injured another woman. According to a news report in the Hays Free Press, the fatal Texas truck accident occurred in Buda when a semi-truck slammed into the man’s pickup truck that was stopped on Interstate 35 for a crash. The out-of-control 18-wheeler hit the pickup, pushing it into another semi-truck, and then hit another pickup pulling a trailer causing it to crash into a van, which was in turn forced into a small car. Officials say the semi-truck driver was going at full speed and made no attempt to stop. Police say the truck driver will be charged with driving at an unsafe speed. Officials expect to file additional charges.

Truck driver negligence can result in major or even fatal accidents. There are a number of reasons why such accidents may occur. A truck driver may have fallen asleep at the wheel because of insufficient rest or breaks. Federal law requires drivers of commercial trucks to take frequent breaks in order to prevent fatigue. Speeding, reckless driving, impairment, distraction, and mechanical failure may also cause a large truck to go out of control.

When a truck hits a passenger car, it is the occupants of the smaller vehicle that suffer catastrophic injuries. In such cases, if a truck driver is determined to have been at-fault, both the driver and his or her employer can be held liable for the victim’s wrongful death or the injuries caused to others. It is important that victims and their families contact an experienced Texas semi-truck crash lawyer who will work to gather critical evidence such as driver logs and vehicle maintenance records to help determine fault and liability.

At least three people were injured recently when a passenger car and a truck hauling fuel crashed on Interstate 30 west of downtown Dallas, according to a recent news report from KWTX. The crash ignited the fuel, causing the tanker truck to explode, which shut down both sides of the interstate.

The driver of the fuel tanker and two people riding in the car were taken to a local hospital for treatment, which were not reported to be life-threatening. No one was killed in the crash or the resulting explosion.

According to Dallas Fire-Rescue personnel, the fuel truck struck the median, resulting in the explosion. At least one car was also involved in the crash, but police are not yet certain how the accident occurred or in which order the vehicles collided with one another or the median. They are also investigating the source of the explosion.

The explosion rattled doors and windows in nearby homes. Both the sound and the fire could be seen from several miles away. Dallas Fire-Rescue crews noted that some of the fuel spilled into a nearby creek, but did not say whether plans have yet been made to clean up the contamination.

The Texas Department of Transportation plans to inspect the section of I-30 where the accident occurred. The inspection will verify that the damaged roadway is safe to drive on. Meanwhile, traffic will be rerouted to avoid the area.

Most U.S. truck drivers work hard to prevent accidents on their routes. Unfortunately, no driver can avoid all possible accidents. Texas motorists who suffer injuries in a collision have certain legal rights and options to help them obtain compensation and move forward after an accident. An experienced Texas truck accident attorney can help injured motorists in Texas learn about their rights and protect them in court.

On Thursday, April 8, 2010, several vehicles crashed on a Highway 121 bridge in Carrollton, Texas according to a report by KDFW Fox News 4. The accident involved a tractor-trailer, a dump truck and a pickup truck on the eastbound lanes of the highway near Interstate 35E on a section commonly known as the Sam Rayburn Tollway (SRT).

A North Texas Tollway Authority dump truck struck a semi that was hauling 40,000 pounds of cargo heading northbound on 35E to eastbound 121. After the initial collision, the semi jackknifed and was hit a second time by a pickup truck.

A fire ignited the three vehicles, causing severe damage to the affected area. The cab of the tractor-trailer was seen dangling over the bridge, attached loosely to the rig. Fortunately, the driver was able to safely escape. Firefighters were called on scene to extinguish the blaze. One of the victims was transported to a local hospital for minor injuries.

Traffic had been delayed for seven hours during cleanup and investigation. All northbound and two southbound tollway lanes remained closed as well as the entrance ramp from northbound I-35 to northbound SRT.

Multi-vehicle accidents, especially ones including large commercial vehicles such as semi trucks, dump trucks and buses, can be devastating to all parties involved. As with many motor vehicle accidents, injuries sustained may not be apparent until the second or third day after the accident.

Regardless of the severity of the injuries, you may be entitled to recover compensation for your losses and traumas. Carrollton personal injury claims involving car and truck accidents require experienced legal counsel and investigation to ensure that your rights are protected.
